The
Commons Act 2006, due to be in force later this year, will sweep aside the
Commons Registration Act 1965 and introduce a completely new scheme for the
registration, management and protection of common land in England and Wales.
The Act will enable the establishment of commons councils and give greater
protection to commons by repealing section 194 of the Law of Property Act
1925 and replacing it with a new statutory system of control. There are also
new rules for the registration of town and village greens based on long
user.
All practitioners
advising on the acquisition, sale, development or management of rural land
